Terms & Conditions

Introduction

These Terms and Conditions govern the sale, supply, installation, and maintenance of solar energy systems by Mesh SolarMart & Beyond (“the Company”) within the Republic of Kenya. By accepting a quotation, making payment, or signing a contract, the Client agrees to be legally bound by these Terms in accordance with the Laws of Kenya.

Services Provided

The Company provides solar system design, supply of solar panels, inverters, batteries and accessories, installation, commissioning, maintenance, and after-sales support services.

Quotations & Pricing

All quotations are valid for 14 days unless otherwise stated. Prices may vary due to currency fluctuations, supplier price changes, tax adjustments, or regulatory changes under Kenyan law. A quotation becomes binding upon written acceptance and deposit payment.

Unless otherwise agreed in writing: –

70% deposit before procurement
30% balance upon completion

Ownership of goods remains with the Company until full payment is received in accordance with the Sale of Goods Act (Cap 31, Laws of Kenya). Late payments may attract a penalty of 3% per month on outstanding amounts.

Delivery & Installation

Installation timelines are estimates and subject to weather conditions, site readiness, and supply chain factors. The Client must ensure safe access and structural integrity of the installation site. Additional works outside agreed scope shall attract additional charges.

Warranties

Manufacturer warranties apply as follows: – Solar Panels: 5 –10 years performance warranty

Inverters: 3 years
Batteries: 3 years

Workmanship warranty: 12 months. Warranties exclude damage from misuse, negligence, natural disasters, power surges, or unauthorized modifications.

System Performance Disclaimer

Solar output depends on weather, shading, and maintenance. The Company does not guarantee uninterrupted electricity supply unless expressly stated in writing.

Maintenance Responsibility

The Client is responsible for routine panel cleaning, battery care, and preventing system overloading. Optional maintenance contracts may be offered separately.

Cancellation Policy

Orders may be cancelled within 48 hours if procurement has not commenced. Deposits become non-refundable once equipment has been ordered or customized.

Limitation of Liability

The Company shall not be liable for indirect or consequential losses including business interruption or loss of profits. Total liability shall not exceed the total contract value paid by the Client.

Force Majeure

The Company shall not be held liable for delays caused by events beyond reasonable control including natural disasters, government restrictions, strikes, or supply shortages.

Data Protection

Client information shall be handled in accordance with the Data Protection Act, 2019 of Kenya and used only for service delivery, billing, and legal compliance.

Dispute Resolution

Disputes shall first be resolved amicably. If unresolved, disputes shall be referred to mediation or arbitration under the Arbitration Act, 1995 (Kenya), and where necessary, courts of competent jurisdiction within Kenya.
